1. Licence grant
Rocket Data Limited grants you a limited, non-exclusive, worldwide, perpetual, non-transferable and non-sublicensable licence to install and use nextSurf on Android devices you own or control for personal, lawful use. This is a licence, not a sale.
2. Restrictions
You may not copy, modify, translate, reverse engineer, remove proprietary notices, rent, sell, sublicense or distribute the app; use it to violate law or build a competing product; or circumvent security controls, except where law prohibits these restrictions.
3. Intellectual property
The app and related rights remain owned by Rocket Data Limited and its licensors.
4. Data and privacy
Use is subject to the nextSurf Privacy Policy. Technical, diagnostic and usage information may be processed as described there and allowed by law.
5. Third-party services and updates
The app may use third-party data and services. Rocket Data does not guarantee their availability or performance. Features, patches and updates may be changed or discontinued where permitted.
6. Termination
Your rights may terminate if you materially breach this agreement. On termination, stop using and delete the app.
7. Warranty disclaimer
To the maximum extent permitted by law, the app is provided “as is” and “as available”, without express, implied or statutory warranties.
8. Limitation of liability
To the maximum extent permitted by law, Rocket Data is not liable for indirect, incidental, special or consequential damages, or loss of profits, data or business. Total liability is limited to the greater of amounts paid for the app in the previous 12 months or USD $50.
9. Compliance and consumer rights
You must follow applicable export and sanctions laws. Nothing in this agreement removes non-waivable consumer rights.
10. Governing law and Google Play
New Zealand law governs this agreement, subject to mandatory local consumer law. This agreement is between you and Rocket Data Limited, not Google. Applicable Google Play terms control if they conflict.
